    CBD oil has become so popular today and thanks to the new law, it is now legal in all the 50 states of United States of America. The 2018 Farm Bill has made CBD legal in all the 50 states. However, there are certain conditions and restrictions on the usage of these products that differ from state to state. This had made things complicated and a little confusing for people.

    Fortunately, there are information available on the legality of CBD in the 50 states and this article will focus on that. CBD has now proved itself to be an effective medical drug, and making it easily available is essential.

    The legality of this substance is essential for making it readily available in various states.

    Here is everything you need to know about CBD and its legality:

    Which type of CBD is Legal?

    CBD can come from various cannabis plants like hemps and marijuana. Not all CBD based products are legal in the states. CDB derived from the hemp plant is legal in all the fifty states while marijuana-driven CBD are not.

    Both marijuana and hemp come from the cannabis plant family, which makes them similar in many ways. However, there are subtle differences in the two plants that makes hemp a better choice than the marijuana. Therefore, the source of the CBD is essential in determining whether its legal or not.

    As for the reasons why, hemp-based CBD is acceptable and not the marijuana-based CBD, the government has laid down some guidelines. Hemp contains less than 0.3% THC and Marijuana contains more than 0.3% of THC. THC is a compound that makes people high and is one of the major compounds found in the cannabis plant along with the CBD.

    To sum-up, hemp-based CBD is legal in all states, while marijuana-based is not legal in every state, only in those states that have made marijuana legal.

    States where CBD is Legal

    While the new Farm Bill has made no-THC CBD legal in all the 50 states, the states have their own rules and regulation about the CBD. It is important to first understand what these laws are how each state has responded towards it.

    • States with CBD Friendly Laws

    Some of the states allow easy availability of CBD based products without much restrictions. These states include the states of Alaska, Indiana, Colorado, Illinois, Oklahoma, Kentucky, Maryland, Missouri, New York, North Carolina, Oregon, Rhode Island, South Carolina, Tennessee, Utah, Texas, Vermont, and Wisconsin.

    • States with CBD less explicit Laws

    States like the District of Columbia, Hawaii, Kansas, Montana, New Mexico, and North Dakota exempt hemp-based CBD from the marijuana category. These hemp plants are grown in agricultural environment that complies with new Farm Bill laws.

    • States with Grey Areas

    There are some states that does not explicitly prohibits the CBD products or its retail sale. It has exemptions in the law that make the hemp-based CBD legal in the area. The states that fall in this category are – Arkansas, Delaware, Florida, Connecticut, Georgia, Idaho, Iowa, Louisiana, Maine, Massachusetts, Nebraska, Minnesota, Mississippi, New Hampshire, New Jersey, Pennsylvania, Virginia, and Washington.

    • States with Risks

    There are states that doesn’t prohibit the sale of the hemp-based CBD, but it does have a few restrictions that make the sale of CBD risky even if they are hemp-based CBD. States under this category include Alabama, Arizona, California, Michigan, Nevada, Ohio, South Dakota, West Virginia, and Wyoming.

    • States that have made Amends in regards to CBD sale

    Some states have made things easier for the sale of hemp-based CBD. In the state of Connecticut, the hemp-based CBD has been made legal and removed from the list of restricted substances. Likewise, Florida has passed the bill that has made the hemp-based CBD totally legal in state.

    States like Georgia, Hawaii, Iowa, Nebraska, New Jersey and other states have started making new changes in the law to accommodate the new Farm Law that has made CBD legal in all the 50 states.

    Know your States

    The legal stats if the CBD and CBD based products sale depends on which state you live in and the local laws and restriction. It is essential that you make yourself familiar with the local laws and permits before your buy or use CBD based products.

    Remember that Hemp-based CBD have less THC level as compared to marijuana, which is not legal in most of the states. Get information and ensure that you are on the right side of the law.

    The Bottom-Line

    The new farm law has made CBD extracted from the Hemp plant legal in all the 50 states. But there are a few restrictions and exemptions for CBD based products in each state. Before you start buying CBD based products make sure its legal in your state.
